Non-Institutionalized Individual
- For a competent individual who is capable of stating intent and living independently from his or her parents or married, the state of residence is the state where the individual is living with the intention to remain there permanently or for an indefinite period OR
- For a non-institutionalized individual whose Medical Assistance is based on blindness or disability, the state of residence is the state in which the individual is living OR
- For any other non-institutionalized individual to whom 42 CFR 435.403(h) (1) or (2) above does not apply, the child is a resident of the State in which the caretaker is a resident.
